Landlord’s Checklist- Legal Requirements

 
  • Energy Performance Certificates
As of 2008 landlords are legally required to produce an EPC summarising the property’s energy performance. The EPC rates the energy efficiency and environmental impact of a property, ranking it from A-G. The certificates are valid for ten years.
 
  • The Gas Safety (Installation and Use) Regulations 1998
The Landlord must make sure the property has a Gas Safety Certificate, carried out by a Gas Safe Registered engineer. This must be repeated yearly. The certificate must be available to the tenants before or at the points of signing the tenancy agreement.
 
  • The Electrical Equipment Regulations 1994
All electrical appliances in the property must be checked annually by a qualified engineer who will give you a PAT certificate.
 
  • The Furniture and Furnishing (Fire Safety Amendment) Regulations 1993     
This regulation states that all furniture has to meet all the current fire resistance requirements. They must all have the appropriate labelling. This applies to beds, head and footboards, mattresses, sofas, pillows, scatter cushions and loose covers for furniture and garden furniture.
 
  • Tenancy Deposit Schemes
Since new legislation in 2007 any deposit taken needs to be held in one of the three Government approved schemes. Failure to do so could lead to court proceedings. The court will order you to reimburse the deposit to the tenant or The Deposit Protection Scheme. Further you would have to compensate the tenant with three times the deposit. If a Landlord does not comply with the new regulation they will not be able to regain possession of the property using the ‘notice only’ ground. All schemes rely heavily on written evidence, therefore we ask all landlords to make sure they have a comprehensive inventory completed.
